Pixazo Fair Use and Responsible AI Policy

1. Ownership and Scope

This Fair Use and Responsible AI Policy (“Policy”) governs the use of Pixazo’s Unlimited Image Generation feature (the “Unlimited Plan”) and forms an integral part of the Terms of Service between the user (“you,” “your”) and Pixazo LLP, a limited liability partnership incorporated in India, with its principal place of business at 165, NSEZ Noida, 201305, India (“AP,” “we,” “our,” or “us”).

AP currently utilizes third parties to process payments (“Third-Party Payment Processors”). Subscribers must make all payments to AP via these processors, currently based in the USA and the UK. AP reserves the right to change or discontinue any Third-Party Payment Processor at any time. Despite any similarity in name, there is no affiliation between AP and any Third-Party Payment Processor, and such processors are not parties to this Agreement.

2. Purpose

The Unlimited Plan is designed to provide users with unrestricted creative freedom while ensuring fair, responsible, and sustainable use of shared AI resources. This Policy protects system integrity and prevents misuse, automation abuse, or excessive resource consumption that could impact performance for others.

Pixazo promotes responsible AI use, encouraging creativity supported by ethical standards, transparency, and human oversight. You remain responsible for reviewing, validating, and ensuring the lawful use of all generated outputs.

3. Definition of “Unlimited”

“Unlimited” means there are no fixed daily or monthly image caps for legitimate, human-led creative use. Pixazo supports continuous generation for individual, professional, and commercial workflows that reflect ordinary design activity.

• Regular creative work by individuals, designers, or agencies.
• Generating variations for design projects or campaigns.
• Collaborative work within a single paid account.

Account-Level Use: The Unlimited Plan is licensed for use by a single individual or organization account. Sharing login credentials or granting access to unrelated third parties outside your organization is prohibited and may result in suspension or termination.

4. Background Resource Management

1. Excessive or high-frequency activity may trigger temporary throttling or queuing.
2. Image resolution or quality may automatically adjust during peak demand.
3. These measures are standard operational safeguards and do not constitute downtime or breach of service.

5. Fair Use Range

Although no explicit numerical limits are published, each account operates within a soft daily and monthly allowance, measured internally in AI processing units rather than image count. Usage is considered fair when consistent with typical human creative workflows. Pixazo may throttle, delay, or suspend accounts demonstrating:

• Continuous generation beyond reasonable human capacity.
• Automated or scripted mass image creation.
• Patterns indicative of resale, redistribution, or exploitation.

Users with sustained high-volume needs may upgrade to an Enterprise or API plan for higher capacity and priority processing. For such inquiries, please contact [email protected].

6. Prohibited Uses

1. Automated or bot-driven image generation without direct human involvement.
2. Bulk scraping, resale, or redistribution of generated images without transformation or added creative value.
3. Using outputs, prompts, or metadata to train, benchmark, or fine-tune external AI systems.
4. Creating or sharing unlawful, obscene, defamatory, hateful, or adult material.
5. Activities breaching Pixazo’s Terms of Service, Content Guidelines, or Community Standards.

7. System-Level Safeguards

Pixazo maintains internal capacity budgets to ensure fair access. If overall usage approaches limits, Pixazo may delay or restrict new generations. These actions are standard and do not entitle users to refunds or credits.

8. Enforcement, Remedies, and Liability

• Throttle or queue requests.
• Suspend or terminate offending accounts.
• Revoke “Unlimited” privileges.
• Seek legal or equitable remedies for serious violations.

No Refunds: Limitations or suspensions for policy enforcement do not qualify for refunds or compensation.

9. Compliance, Moderation, and Data Handling

Pixazo screens all prompts and outputs for prohibited content. Metadata may be retained for up to 90 days for diagnostics and compliance. Generated content may be deleted or anonymized after this period unless legally required to retain it.

10. Updates to This Policy

Pixazo may amend this Policy periodically. Updated versions will appear at https://www.pixazo.ai/fair-use-policy. Continued use implies acceptance of updates.

11. Interpretation and Severability

If any provision is held invalid, remaining terms continue in full effect. Failure to enforce a right is not a waiver.

12. Governing Law

This Policy is governed by the laws of India, with exclusive jurisdiction in New Delhi courts.
